Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are an agreement between you and DotStorm, LLC ("DotStorm," "we," "us," or "our"). They govern your use of the DotStorm website, calendar, applications, and related services (collectively, the "Service").

By creating an account, clicking to accept these Terms, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service for an organization, you represent that you are authorized to act for that organization.

2. Eligibility

You must be at least 18 years old, legally able to enter into a binding agreement, and not prohibited by law from using the Service. By creating an account, you represent that you meet these requirements.

3. Accounts

You may create or access an account using email, Google, Discord, or another method we support. You must provide accurate information, protect your account, and promptly notify us of unauthorized use.

Creating an account does not establish that you belong to a particular organization, community, role, or group.

You may connect supported third-party accounts and calendars. You may connect only accounts that belong to you or that you are authorized to use.

4. The Service

DotStorm is a calendar and alert platform. Organizations and communities ("Partners") may publish events, announcements, registrations, and related information through the Service.

Users may follow Partners and projects and view relevant events and announcements on a DotStorm calendar. Information shown to a User may be based on the User's selections, community associations, and information available through accounts the User chooses to connect.

Users may choose to connect their Google Calendar through Google's OAuth authorization process. When enabled, DotStorm may add, update, or remove DotStorm-related entries in that calendar.

DotStorm may provide a Partner with registration and engagement information relating to that Partner's own content and community. Our Privacy Policy explains how we handle this information.

Features may vary and may be added, changed, suspended, or discontinued.

Users are not charged fees for using the Service. Fees for Partners, if any, are set forth in a separate Order Form or Partner Agreement between the Partner and DotStorm.

5. Partner Content and Events

DotStorm provides the technology through which Partners publish and distribute their content. DotStorm does not organize, sponsor, operate, verify, recommend, or endorse a Partner, event, announcement, promotion, project, or community merely because it appears through the Service.

Partners are solely responsible for:

  • their events, announcements, content, and communications;
  • the accuracy and legality of the information they publish;
  • registrations, admission, eligibility, attendance, safety, cancellations, refunds, and fulfillment; and
  • obtaining the rights and permissions needed for their content.

DotStorm does not guarantee that an event will occur, that Partner information is accurate, that space will be available, or that a User will qualify or be admitted. Users should confirm important information directly with the Partner.

DotStorm does not hold funds, digital assets, private keys, seed phrases, or wallet credentials and does not execute blockchain transactions. A wallet address may be used to help associate a User with relevant content, but it does not conclusively establish identity, ownership, membership, or eligibility.

6. Acceptable Use

You may not:

  • use the Service unlawfully, fraudulently, or deceptively;
  • harass, threaten, impersonate, or harm another person;
  • send spam, malware, or unauthorized advertising;
  • interfere with the Service or attempt unauthorized access;
  • scrape, reverse-engineer, or use automated access without our permission;
  • circumvent security, access, registration, or community restrictions;
  • misrepresent your identity, authority, membership, or eligibility;
  • submit content you do not have the right to use;
  • manipulate registrations, roles, activity, or analytics; or
  • violate the rules of a connected third-party service.

Do not rely on DotStorm alerts for emergencies, safety matters, or critical medical, legal, or financial deadlines.

7. Intellectual Property

DotStorm owns the Service, including its software, design, name, logo, and DotStorm-created content. We grant you a limited, revocable, non-transferable right to use the Service for its intended purpose.

Users and Partners retain ownership of content they provide. By providing content, you grant DotStorm a non-exclusive, worldwide, royalty-free license to host, format, display, distribute, and deliver it as needed to operate and improve the Service. You represent that you have the rights needed to provide that content.

We may use feedback or suggestions without restriction or compensation. "DotStorm" and the DotStorm logo may not be used without our written permission.

8. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect information. It is available at https://portal.dotstorm.com/privacy. DotStorm accesses Google APIs only with the user's explicit authorization, and DotStorm's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. Additional disclosures may be presented when you connect an account or enable a feature.

9. Third-Party Services

The Service may connect with third-party platforms, calendar providers, identity providers, and other third-party services. Your use of those services is subject to their own terms and privacy practices.

When you connect a third-party service, including Google Calendar, you authorize DotStorm to access only the permissions explicitly granted during the authorization process and solely for the purpose of providing the requested integration described in our Privacy Policy.

DotStorm is not responsible for a third party's services, security, availability, accuracy, policies, or actions. We may change or discontinue an integration.

Disconnecting an integration may stop future activity but may not automatically remove information or calendar entries previously created.

10. Suspension, Termination, and Account Deletion

You may stop using the Service and request deletion of your account at any time.

We may suspend, restrict, or terminate access if you violate these Terms, create a security or legal risk, misuse the Service, or if required by law or a third-party platform.

Account deletion may not immediately remove information from backups, security records, legal records, Partner records, or third-party services. Calendar entries previously created in an external calendar may remain until separately removed. Deleting a DotStorm account also terminates future access to connected Google accounts.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT EXPRESS OR IMPLIED WARRANTIES.

DOTSTORM DOES NOT GUARANTEE THAT THE SERVICE, AN INTEGRATION, AN ALERT, A CALENDAR ENTRY, PARTNER CONTENT, A REGISTRATION, OR A COMMUNITY MATCH WILL BE AVAILABLE, TIMELY, COMPLETE, SECURE, OR ACCURATE.

ALERTS MAY BE DELAYED, DUPLICATED, INCORRECTLY TIMED, OR NOT DELIVERED. USERS ARE RESPONSIBLE FOR CONFIRMING IMPORTANT EVENT INFORMATION AND DEADLINES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOTSTORM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, DATA, OPPORTUNITIES, REGISTRATIONS, DIGITAL ASSETS, OR EVENT ACCESS.

THIS INCLUDES LOSS ARISING FROM PARTNER CONTENT OR CONDUCT; CANCELLED, DELAYED, UNSAFE, OR MISREPRESENTED EVENTS; MISSED OR INACCURATE ALERTS; INCORRECT COMMUNITY MATCHES; THIRD-PARTY SERVICES; OR UNAUTHORIZED ACCOUNT ACCESS.

DOTSTORM'S TOTAL LIABILITY ARISING FROM THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DOTSTORM DURING THE 12 MONTHS BEFORE THE CLAIM AROSE.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED.

13. Governing Law

These Terms and disputes relating to them or the Service are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

Except where applicable law provides otherwise, disputes must be brought in the state or federal courts serving Fairfax County, Virginia, and each party consents to those courts' jurisdiction.

14. Changes to These Terms

We may update these Terms. If a change is material, we will provide reasonable notice, such as by email or through the Service. We may require you to accept revised Terms.

Changes apply after their effective date. Your continued use after that date means you accept the revised Terms. If you do not agree, stop using the Service.

16. Copyright Complaints (DMCA)

DotStorm respects intellectual property rights and responds to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA").

If you believe content available through the Service infringes your copyright, send a written notice to our designated agent at info@dotstorm.com including:

  • identification of the copyrighted work claimed to be infringed;
  • identification of the material you claim is infringing and its location on the Service;
  • your contact information;
  • a statement that you have a good-faith belief the use is unauthorized;
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and
  • your physical or electronic signature.

We may remove or disable access to material claimed to be infringing and may terminate accounts of repeat infringers.

17. Indemnification

You agree to defend and indemnify DotStorm and its affiliates, officers, employees, and contractors against claims, losses, and reasonable costs arising from your content, misuse of the Service, violation of these Terms, or infringement of another person's rights.

If you use the Service for a Partner, this obligation also applies to that Partner's content, events, announcements, registrations, promotions, and interactions with Users.

18. General Terms

These Terms and the Privacy Policy are the entire agreement between you and DotStorm concerning the Service. If part of these Terms is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver.

You may not assign these Terms without our permission. We may assign them in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Service.

Provisions that by their nature should continue after termination will survive, including intellectual-property, disclaimer, liability, indemnification, dispute, and general provisions.
